These terms govern your use of the public website at nichenudge.com and, in section 5, individual access to the application. They do not replace client engagements — those are covered by the specific contract signed for each engagement, which prevails where the two overlap.

1. Agreement

These terms are an agreement between you and Niche Nudge LLC, a Delaware limited liability company (“Niche Nudge”, “we”). By using this website you agree to them. If you don’t agree, please don’t use the site. We may update these terms from time to time; the “last updated” date at the top reflects the most recent change.

2. What we offer here

The website provides information about Niche Nudge’s services, calculators that estimate metrics based on inputs you provide, and contact mechanisms. None of the calculator outputs constitute professional advice — they are estimates, intended to inform a conversation, not to replace one.

3. Calculator outputs

The benchmark numbers used in our calculators are compiled from public sources and our own engagement data. They represent typical ranges, not guarantees. Your specific situation may produce results materially different from the estimates. We do not warrant that any calculator output is accurate for your business.

4. Acceptable use

You may not: scrape the site at scale, attempt to bypass authentication or rate limits, submit calculator forms automatically, or use the site to harass or spam us. You may not probe, scan, or test the security of the site or the application without our prior written permission. If you believe you’ve found a security issue, we welcome good-faith reports at admin@nichenudge.com. We reserve the right to block access to anyone who violates this section.

5. Application access

Parts of nichenudge.com/app are available only to invited accounts. Accounts are individual: keep your sign-in factors — email access, passkeys, and authenticator codes — to yourself, and tell us promptly at admin@nichenudge.com if you believe your account is compromised. Certain areas require a verified second factor, and we may require you to enrol one before granting or continuing access. We may suspend or limit access where we reasonably believe it is necessary for security or to address a violation of these terms. If you use the application under a client engagement, the signed agreement for that engagement prevails over this section.

6. Intellectual property

The site, including its design, code, copy, and logos, is owned by Niche Nudge (with the exception of third-party logos shown on /work, which remain the property of their respective owners and appear with permission or under fair use). You may not reproduce or redistribute this content without permission.

7. Third-party links

The site links to third-party services and websites. We’re not responsible for the content, practices, or terms of those services.

8. Disclaimers

The site is provided “as is” without warranty of any kind, express or implied. We don’t warrant that the site will be uninterrupted, error-free, or that any information on it is current.

9. Limitation of liability

To the fullest extent permitted by law, Niche Nudge will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the site, regardless of the legal theory.

10. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules, and disputes that cannot be resolved informally will be resolved in the state or federal courts located in Delaware. If you use the site as a consumer in the EU, EEA, or UK, you keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts.
